CallPal provides an AI-powered phone receptionist service that uses artificial intelligence to handle incoming phone calls for businesses. The Service includes:

  • Automated call answering and handling using AI technology
  • Natural language processing to understand customer inquiries
  • Integration with third-party services (e.g., appointment scheduling, POS systems)
  • Call recording and transcription capabilities
  • Analytics and reporting on call interactions

3. Account Registration and Security

To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account
  • Ensuring that all information provided is accurate and up-to-date

4. AI Service Limitations

You acknowledge and agree that:

  • The AI receptionist is an automated system and may not always provide perfect responses
  • AI responses are generated based on available information and may contain errors or inaccuracies
  • We do not guarantee that the AI will handle all calls correctly or completely
  • You are responsible for monitoring and reviewing AI interactions and call outcomes
  • The Service may require human intervention in certain situations

5. Acceptable Use

You agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Attempt to reverse engineer, decompile, or extract the AI technology
  • Interfere with or disrupt the Service or servers connected to the Service
  • Use the Service to transmit any harmful, offensive, or inappropriate content
  • Impersonate any person or entity or misrepresent your affiliation
  • Use automated systems to access the Service without authorization
  • Share your account credentials with unauthorized parties

6. Call Recordings and Data

By using the Service, you acknowledge that:

  • Call recordings and transcripts may be created and stored as part of the Service
  • Call data may be used to improve and train our AI models
  • You are responsible for complying with applicable laws regarding call recording and customer consent
  • You must inform callers if calls are being recorded, where required by law
  • We may retain call data for service improvement, quality assurance, and legal compliance

7. Third-Party Integrations

The Service may integrate with third-party services (e.g., Square, Acuity Scheduling, Stripe). You acknowledge that:

  • Use of third-party services is subject to their respective terms and conditions
  • We are not responsible for the availability, accuracy, or functionality of third-party services
  • You are responsible for maintaining valid credentials and authorizations for integrated services
  • We may share necessary data with third-party services to provide functionality

8. Payment Terms

If you subscribe to a paid plan:

  • Fees are charged in advance on a recurring basis (monthly or annually)
  • All fees are non-refundable except as required by law
  • You authorize us to charge your payment method for all fees
  • Price changes will be communicated with at least 30 days' notice
  • Failure to pay may result in suspension or termination of your account

9. Intellectual Property

The Service, including all AI technology, software, and content, is owned by CallPal and protected by intellectual property laws. You agree that:

  • You will not copy, modify, or create derivative works of the Service
  • You will not remove any proprietary notices or labels
  • You retain ownership of your business data and content
  • You grant us a license to use your data to provide and improve the Service

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, or non-infringement
  • Warranties that the Service will be uninterrupted, error-free, or secure
  • Warranties regarding the accuracy or reliability of AI responses
  • Warranties that the Service will meet your specific requirements

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CALLPAL SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Errors or inaccuracies in AI responses or call handling
  • Service interruptions or unavailability
  • Any damages exceeding the amount you paid to us in the 12 months preceding the claim

12. Indemnification

You agree to indemnify and hold harmless CallPal, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for:

  • Violation of these Terms
  • Non-payment of fees
  • Fraudulent or illegal activity
  • At our sole discretion, with or without cause

Upon termination, your right to use the Service will cease immediately. You may terminate your account at any time by contacting us or through your account settings.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts of Sacramento County, California.
